Delaware Social Equity Opportunity

Delaware’s social equity program was designed to create a more inclusive and equitable marijuana industry by providing opportunities for those disproportionately impacted by past marijuana laws. The program benefits individuals with past marijuana-related convictions and residents of neighborhoods heavily affected by past marijuana enforcement. A portion of available licenses are specifically designated for social equity applicants

Applications open for all license types September 1, 2024
A social equity license is a special license based on ownership qualifications. A social equity applicant is a Delaware resident who meets one of the following criteria:
  • A Delaware resident who as resided for at least 5 of the preceding 10 years in a disproportionately impacted area.
  • OR a Delaware resident who meets one of the following criteria:
    • Was convicted of or adjudicated delinquent for any marijuana-related offense prior to April 23, 2023 except any of the following:
      • Delivery to a minor, Any marijuana offense with a Tier 3 quantity of marijuana as defined in § 4751(c) of Title 16, or The functional equivalent of the offenses described above
    • Has a parent, legal guardian, child, spouse, or dependent who was convicted of or adjudicated delinquent for any marijuana-related offense prior to April 23, 2023.

Types of Social Equity Licenses Available

 
  • Cultivation Licenses:
    • Small Cultivator: 10 Social Equity Licenses
    • Standard (Big) Cultivator: 10 Social Equity Licenses
 
  • Manufacturing Licenses: 10 Social Equity Licenses
 
  • Retail Licenses: 15 Social Equity Licenses
 
  • Testing Facility Licenses: 2 Social Equity Licenses
